Madras High Court Rejects Employee's Claim for Special Grade After Delaying Promotion Posting

The Madras High Court has ruled that a government employee cannot postpone joining a promotional post merely to become eligible for Special Grade benefits in the previous post. The Court held that once an employee is promoted before completing the required qualifying service, they generally lose the right to claim Special Grade benefits attached to the lower post.

A Division Bench comprising Justice N. Sathish Kumar and Justice M. Jothiraman delivered the judgment while dismissing an appeal filed by an Agriculture Department officer who challenged the revision of his pay fixation.

The appellant, M. Balasubramanian, was serving as an Agricultural Officer and was promoted to the post of Assistant Director on 17 December 2012. However, instead of immediately taking charge of the promoted post, he went on medical leave and assumed charge only on 20 January 2013. By that date, he had completed 20 years of service and claimed that he was entitled to Special Grade benefits available to Agricultural Officers.

The authorities disagreed and revised his pay fixation, taking the view that since he had already been promoted before completing the qualifying period, he was not entitled to receive Special Grade benefits in the lower post.

Before the High Court, the employee argued that he completed 20 years of service on the day he resumed duty and therefore should receive the Special Grade. He also contended that the promotion order had been communicated to him while he was on medical leave.

The Court, however, found no merit in these arguments. It observed that there was no dispute that the promotion had already been granted before the completion of the qualifying service period. According to the Bench, an employee who receives promotion before becoming eligible for Special Grade benefits cannot claim those benefits simply by delaying assumption of the higher post.

The judges noted that the sequence of events suggested that the officer intentionally postponed joining the promotional position until he completed the required years of service. The Court held that such a course of action could not be used to secure financial benefits that were otherwise unavailable.

Upholding the decision of the Accountant General and the earlier order of the Single Judge, the Court concluded that the employee was not entitled to Special Grade benefits and dismissed the appeal.

The judgment reinforces the principle that service benefits must be determined based on the actual date of promotion and eligibility conditions, and cannot be obtained through deliberate delay in joining a higher post.
